This policy governs the collection and processing of personal data on the www.headachehasgone.com website, determines the purposes for and the period of storing personal data, how the stored data can be accessed, modified and erased, and how to find further information on data processing.

Subscribing to the website, invoicing, registering and fulfilling the subscription, documenting the subscription and payment, fulfilling accounting obligations, maintaining subscriber relations, measuring subscriber satisfaction, improving subscription-related services, analysing subscribers’ purchasing habits, targeted sales and remarketing enquiries.

In the course of selling the HRP program, www.headachehasgone.com is entitled and obliged to electronically record and process the following data about subscribers in accordance with Act CXII of 2011 on Informational Self-Determination and Freedom of Information (“Privacy Act”):

a) in the general case:

  • name,
  • e-mail address,
  • billing address,
  • phone number,

During the purchase process, the name, e-mail address and payment details of the subscriber are transferred to Paypal to complete the online payment by Paypal.

The information on how to erase such data is available in Paypal’s Privacy Policy at www.paypal.com.


The subscriber is required to provide their e-mail address for the subscription and thereby acknowledge that this e-mail address may be used by private entrepreneur György Baglyas to send 2 e-mails informing about the subscription duration during the subscription period. If the subscriber unsubscribes during the subscription period, the subscriber acknowledges that the 2 pieces of information about the subscription period cannot be sent to them, and, therefore, the service cannot be fully provided to them.

If the subscriber and the website’s visitor provide their email address, they acknowledge that this e-mail address may be used by private entrepreneur György Baglyas to send 3 newsletters and, in the case of subscribers, to send an e-mail inquiring about the effects of the HRP program.

Private entrepreneur György Baglyas undertakes that in each newsletter sent electronically the recipient can unsubscribe from the mailing list.

The Data Controller agrees to erase the data of the unsubscribed person from their mailing list immediately after receiving the user’s request to unsubscribe.

Once the online subscription payment by credit card through Paypal is made via the www.headachehasgone.com website, the data provided will be processed in accordance with sections II and III.

The legal basis for data processing is the legal obligation as set out above and the individual authorisation of the data provider.

Unsubscribe

In the case of data provided to facilitate information and contact, the user can unsubscribe from future notifications at the following addresses:

  • the “unsubscribe” option in the current newsletter,
  • the e-mail address of the company listed in the Introduction,


Modification of data

In the case of data provided to facilitate information and contact, the data may be modified by sending a communication to the address indicated in the introduction.

Storage of data
The data controller has the necessary and appropriate technical means to store and protect the data and to prevent unauthorised access and misuse.


The retention period of the data processed:

  • the subscriber’s personal data are retained for the duration of the subscription and for 6 years from the year following the termination of the contract,
  • the Data Controller retains invoices issued in connection with contracts (pursuant to Section 169 (2) of the Accounting Act) for 8 years.

The Data Controller uses Google Analytics, Google Remarketing, Google Ads Conversion Tracking, and Facebook Remarketing to measure traffic to the www.headachehasgone.com website and to monitor visitor behaviour, statistics and the effectiveness of its advertising. These programs place so-called cookies on the visitor’s computer, which collect user data.

External servers help independently measure and audit website traffic and other web analytics data, which is what the Google Analytics statistics cookies are designed to do. These can be used to track how visitors use the website and which pages they visit. These cookies do not collect any personally identifiable information about visitors: all data is collected anonymously and is used by Google to evaluate how visitors use the website, as well as to provide the website operator with reports on website activity and to perform other services relating to website and internet usage.

The Data Controller also uses Google Ads, within the framework of which it uses Google’s conversion tracking service. This means that when a visitor reaches a website through a Google ad, a cookie is placed on their computer for conversion tracking. These cookies are set to expire and do not contain any personal data, so the visitor cannot be identified by them, but when the visitor browses certain pages of the website and the cookie has not expired yet, Google and the Data Controller can see that the visitor has clicked on the advertisement. Each Google Ads client receives a different cookie, so they cannot be tracked through the websites of Ads clients. The information obtained thereby is used to generate statistics for customers who choose Ads for tracking. Private entrepreneur György Baglyas can thus be informed about the number of users who click on his advertisement and are forwarded to the page with the conversion tracking tag. However, they do not have access to information that would allow them to identify any user.

The Data Controller uses Facebook Remarketing to increase the effectiveness of Facebook ads for the purpose of building a remarketing list. This means that when you visit the website, an external service provider such as Facebook may display advertisements on websites. Remarketing lists are not suitable for personal identification. They do not contain any personal data of the website visitor but only identify the browser software.

Visitors to the www.headachehasgone.com website will be notified of cookie use in the pop-up at the bottom of the website, where they can click the appropriate button to indicate whether they accept the use of cookies on the site. In any case, the Data Processor may only act on the instructions of the Data Controller, who shall determine the way in which the data are used and the purpose of the processing. The Data Processor may not process personal data received from the Data Controller for its own purposes or for purposes other than those specified in its contract.

Activity performed by Data Processors: Issue an invoice for the purchase made on the website, in full compliance with the legal requirements. For this purpose, the Data Controller transfers the billing name, address and purchase price data to the Data Processor.

Activity performed by Data Processor: Sending marketing materials and information to subscribers to the newsletter, with the content specified by the Data Controller. For this purpose, the Data Controller provides the Data Processor with the e-mail list of the subscribers to the newsletter.

MailChimp is a US company registered under the Privacy Shield, the framework for the commercial transatlantic exchange of personal data, so MailChimp has agreed to provide an adequate level of protection for personal data so that personal data can be transferred to MailChimp from the European Union.

General Terms and Conditions

The present General Terms and Conditions (hereinafter referred to as “GTC”) define the rights and obligations arising from the legal relationship between the subscribers (hereinafter referred to as “Customer”) of the Headache Relief Program (hereinafter referred to as “HRP”) available via the website www.headachehasgone.com and private entrepreneur György Baglyas (hereinafter referred to as “Service Provider”).

On the website headachehasgone.com, the Service Provider offers a subscription package of 6 relaxations and 3 pdf files of self-training, which can be completed online, with a 1-month subscription period, called the Headache Relief Program, designed to relieve the symptoms of headaches.

HRP is not a medical, health service. The subscription can be used if the Customer – prior to the subscription – has attended a specialist examination for headache and has used or is using the treatment offered by the doctor. Subscribing to HRP at headachehasgone.com and completing the program is not a substitute for modern medical care.

CONCLUSION OF THE CONTRACT

Subscription information:

Subscriptions can only be made via the headachehasgone.com website. The Service Provider provides information on the subscription to the Customers electronically (via the website or via email). 
The Customer can start the subscription process by clicking on the “HRP registration” button. When you start your subscription, the system asks for basic subscription data on the /Checkout subpage. Basic data: e-mail address and password chosen by the Customer. If the Customer requests an e-invoice, they must also enter their billing details (name, address and, in the case of a business, tax number) in the system in the relevant data fields. After the purchase, an e-invoice for your purchase will be sent to the e-mail address you provided. The PayPal online payment system used on the website automatically sends a payment confirmation after the payment has been made. The Service Provider is tax-exempt.

If, after completing the data fields, the Customer decides to start the online payment process with PayPal’s bank card system or a PayPal account, they can do so by clicking on the “Submit” button after verifying the subscription details and the total purchase price to be paid.

The Customer can finalise their subscription to the HRP program by clicking on the “Submit” button. The subscription is deemed to be completed when the subscription amount appears on the Seller’s PayPal account.
A subscription finalised by the Customer is considered an offer by the Customer. 

Confirmation of the order

The Service Provider automatically and immediately confirms validation of the subscription to the Customer by e-mail. This automatic confirmation e-mail informs the Customer or the person to whose benefit the Customer has made the payment of the subscription to the Service Provider about the receipt of the subscription, the activation of the subscription, the link to access the HRP content, the email address required for access and the subscription period.

With the subscription confirmation sent by the Service Provider to the Customer, the contract is concluded between the parties electronically. The language of the contract is English. The subscription price is the price valid at the time of the subscription.

During the subscription period, the Service Provider informs the Customer about the duration of the subscription 2 times by sending an e-mail to the e-mail address provided by the Customer.

Filing of subscriptions

Subscriptions are registered by the Service Provider on its server. Registered Customers can track the remaining period of their subscription on the \Program page.

The service offered with the subscription:

The Service Provider offers the HRP subscription developed by private entrepreneur György Baglyas on the website headachehasgone.com. The HRP is a 5-day relaxation exercise series consisting of 6 audio files supplemented with 3 pdf documents.
By subscribing, the Customer gains access to the HRP program content on the /Program page for a period of 1 month using the e-mail address and password provided at the time of placing the order.
The content of the HRP is only available to the Customer after activation of the subscription by logging in and navigating to the /Program subpage.
The Customer with a valid subscription is entitled to download and print 3 pdf files from the /Program subpage and store them during the subscription period. The Customer is entitled to listen to the 6 relaxation exercises on the /Program page via the website during the subscription period. The 6 relaxation audio files are not downloadable, they are stored on the Service Provider’s server.
Before subscription, the Service Provider provides visitors of the website with the opportunity to listen to the HRP’s first “Starting relaxation exercise” free of charge on the website headachehasgone.com.
Completing the HRP means the following: Listening to the 6 relaxation exercises in the order and manner described in the HRP Timetable pdf file, reading the HRP Workbook and completing the exercises in it.

Information about the HRP and its main features is available to the Customer on the home page of the headachehasgone.com website and on the /What is the HRP? subpage. The Customer is informed about the method and technique of relaxation on the /Relaxation page. Information on the individual HRP relaxations is available on the /Program subpage after the Customer has logged in. The subscriber is informed about the schedule of the relaxations in the HRP Schedule pdf file. Further information on the HRP is provided to the Customer in the HPR Workbook and the HRP Q&A pdf files. 

Purchase Price:

The price shown on the website at the time of subscription is in USD. The purchase price is indicated on the landing page and on the /Checkout page before the subscription is ordered.

Payment:

The subscription is paid via the PayPal online payment system. The Customer can buy the subscription without a PayPal account. The Customer can only pay for the subscription electronically and only in advance.
The full purchase price is deemed to have been paid once credited to the Service Provider’s PayPal account.

Right of withdrawal:

In the case of a distance contract, the Customer or a third party subscribed by the Customer has the right of withdrawal/cancellation without justification within fourteen days from the date of the conclusion of the contract for the subscription of the service. The Customer may exercise the right of withdrawal during the day of conclusion of the contract and during the subscription period. The Customer has the right to withdraw the offer before the conclusion of the contract, which terminates the obligation to make an offer for the conclusion of the contract.

In the event of cancellation, the Customer’s access to the HRP program content at the /Program subpage is deleted. Upon termination of the subscription, the Customer will no longer be entitled to use the printable pdf files.

The Customer may exercise their right of withdrawal by sending a clear declaration to this effect electronically (to info@headachehasgone.com) or by sending a completed copy of the declaration form, which is an annex to these GTC, to the Service Provider’s registered office address in accordance with Government Decree 45/2014 (II.26.). To exercise the right of withdrawal, the name of the Customer and the email address used for the subscription or the invoice confirming the purchase are required. In case of notification by mail, the Service Provider shall take into account the date of posting, in case of notification by email, the date of delivery of the e-mail for the purpose of calculating the deadline. 

In the event of withdrawal, the Service Provider shall immediately, but no later than within fourteen days of becoming aware of the withdrawal, refund the total amount paid by the Customer as consideration, in the same manner as the payment method used by the Customer.

Limitation of liability:

The Service Provider does not assume any liability for any errors, inconveniences, direct or indirect damages caused by the technical (hardware, software) or communication (internet) infrastructure used when connecting to the headachehasgone.com website, whether caused by the server or client side malfunction or any extraordinary malfunction.

The Service Provider is not obliged to extend the Customer’s subscription if the headachehasgone.com website is unavailable due to the installation of security and other software updates on the server side for the purpose of its proper operation.
The Customer may request an extension of their subscription via e-email sent to customer service if the headachehasgone.com website is unavailable for at least 24 hours continuously due to server side malfunction. In this case, in order to facilitate identification, the Customer is required to send the name and email address used during the subscription and the subscription renewal request to the Service Provider’s email address.

The Service Provider points out on the headachehasgone.com website and in the Legal Notice of the website, as well as in the HRP Workbook in case of subscription, that the Customer with recurrent headache symptoms needs a medical examination and informs the Customer that the HRP relaxation program is not a substitute for medical care.

Complaints handling:

The Customer may contact the Service Provider’s staff with any questions, comments or complaints related to their order using the contact details provided above. The Customer’s primary means of complaint handling is by electronic mail at info@headachehasgone.com. The Service Provider shall send its position on the investigation of the complaint to the Customer within 30 days, and shall inform the Customer of the legal remedies available to the Customer against the content of the letter in response to the complaint.

If any dispute between the Service Provider and the Customer is not settled in the course of negotiations between the parties, the Customer may initiate court proceedings, and in the event of a consumer complaint, the Customer may turn to the consumer protection department of the competent government office or to the conciliation body of the competent chamber of commerce and industry (a list of conciliation bodies can be found at http://www.fogyasztovedelem.kormany.hu/node/8579). The Customer can also use the online dispute resolution (ODR) platform available at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage.

The Headache Relief Program – HRP is the intellectual property of private entrepreneur György Baglyas.

The headachehasgone.com website as a whole as well as its graphic elements, text, relaxations, technical solutions and elements of the service are protected by copyright or other intellectual property rights. Of the content available at the headachehasgone.com website, Customers with valid subscriptions can download and print the HRP documents, i.e. the HRP Workbook, HRP Timetable and HRP Questions & Answers pdf files. The Customer is not entitled to copy or transfer to third parties, electronically or physically, any HRP documents that can be printed, during or after the subscription period. Any relaxation audio material beyond the HRP documents listed herein and the headachehasgone.com website, either in part or in full, is permitted to be saved to the cloud or on a physical or other storage media, or printed or played in public exclusively with the prior written consent granted by the Service Provider.

In addition to the rights expressly set forth in these GTC, the subscription and the use of the headachehasgone.com website, or any provision of these GTC, does not grant the Customer any right to any use or exploitation of any trade name or trademark on the website.
The Service Provider reserves all rights to all elements of its service, in particular to the domain names http://headachehasgone.com, http://mostmulik.hu and http://painhasgone.com, their subdomains, all other domain names reserved by the Service Provider, their subpages and their advertising spaces on the Internet. Any activity aimed at delisting, organizing, archiving, hacking or decrypting the Service Provider’s database is prohibited.

Miscellaneous provisions:

The Service Provider is entitled to send the Customer a newsletter or other information letter, provided that the Customer has given their prior, express and voluntary consent to this at the time of registration. The Customer has the right to withdraw this consent at any time, except for information letters about the subscription period, in which case the Service Provider will not send the Customer any more newsletters or other information letters, and will erase the Customer’s data from the database of the users subscribed to the newsletter.

The Customer can access the Service Provider’s Privacy Policy by opening to the Privacy Policy available at the bottom of the headachehasgone.com website.

In matters not regulated in these General Terms and Conditions, the provisions of Act V of 2013 on the Civil Code (Civil Code), in the case of consumer contracts, the provisions of Government Decree 45/2014 on the Detailed Rules of Contracts Concluded Between Consumers and Businesses, and other relevant legislation shall apply.

The Service Provider may unilaterally modify these General Terms and Conditions at any time. The amended provisions will apply to subscriptions registered after the entry into force of the amended provisions.

The provisions of these General Terms and Conditions shall remain in force from 21 June 2021 until revoked and/or amended.

The Headache Relief Program (HRP) is a method that does not qualify as a medical service, and is based on relaxation exercises designed to relieve and eliminate the symptoms of headaches.
The HRP method was not developed by a doctor or pharmacist.
The HRP method is the result of twenty years of independent, daily practice in meditation and self-awareness; nearly a decade of experience in teaching relaxation and mental pain relief techniques; countless formal and non-formal trainings; and continuous self-training. The development of the HRP method has been assisted by the experience of teaching thousands of students learning relaxation, including those in pain.
On the website and in the HRP Workbook, visitors and subscribers are reminded that headache is a symptom that should be treated by a doctor.
In many cases, headaches are caused by stress and poor lifestyle choices. Experience shows that the symptoms can be effectively reduced by relaxation techniques. However, in the case of recurrent headaches in particular, the HRP subscription may be used under the individual responsibility of the subscriber, provided that the subscription has been preceded by a thorough medical examination and/or treatment. Relaxation is not a substitute for modern medical care! Anyone with symptoms of regular headaches should undergo medical examination. If you are already under medical treatment, use HRP as a complementary treatment and do not stop your medical treatment.
